GENERAL BID CONDITIONS FOR VEHICLE

Bids shall be accepted online until 11:25 am prevailing time, Wednesday, June 5, 2024.  In the event of a bid arriving within 2 minutes of the bid closing, the closing may be extended by 2-minute increments until no further bids are received.

Bidders are responsible for examining items prior to bidding and are therefore strongly urged to do so.  Bid items may be viewed by scheduling an appointment with Sandie Waterman at 508-999-0740 or swaterman@town.dartmouth.ma.us prior to the bid opening date (excluding Friday, Saturday, Sunday, and Holidays).

All bidders agree, by submission of bid, to the following terms and shall be required to sign a non-collision and tax form at the time of bid acceptance.

The bidder certifies under penalties of perjury that this bid has been made and submitted in good faith and without collusion or fraud with any other person. As used in this certification, the word “person” shall mean any natural person, business, partnership, corporation, union, committee, club or organization, entity, or group of individuals.

Pursuant to M.G.L. c. 62C, Sec 49A, the bidder must certify under the penalties of perjury that, to the best of their knowledge and belief, the bidder is in compliance with all laws of the Commonwealth of Massachusetts relating to taxes, reporting of employees and contractors, and withholding and remitting child support.

The Town reserves the right to reject any and all bids, or to accept the bid deemed to be in the best interest of the Town of Dartmouth.

INSPECTION

Bidders are responsible for examining items prior to bidding and are therefore strongly urged to do so.  Bid items may be viewed by scheduling an appointment with Sandie Waterman at 508-999-0740 or swaterman@town.dartmouth.ma.us prior to the bid opening date (excluding Friday, Saturday, Sunday and Holidays).

PICK-UP BY THE BUYER

The Town is not responsible for damage to bid items. Ownership passes to the buyer only after full payment has been made to the Town.

All bidders are advised that all items are sold “as is” “where is” with no warrantee expressed or implied. The successful bidder shall assume all liability for the vehicle after the sale transaction. Bidder agrees by bidding that the Town of Dartmouth shall be held harmless for any issues or occurrences after the BUYER takes possession. Bidders are advised that all items are excess, outlived their useful life and/or surplus to the Town of Dartmouth’s needs. The Town of Dartmouth has made every attempt to provide the best information available on each item being auctioned and shall not be held responsible for information that is not accurate.

The BUYER shall pick-up the vehicle within 15 days (Friday, Saturday, Sunday and Holidays excluded) of the notification by the OWNER that the equipment is ready for pick-up.  The BUYER will be required to coordinate the removal of the material with Sandie Waterman at 508-999-0740 or swaterman@town.dartmouth.ma.us. The pick-up shall be made during normal business hours, 8 a.m. to 2 p.m., Monday through Thursday, in the presence of an authorized employee of the Department of Public Works. The cost of pick-up and transportation shall be the sole responsibility of the BUYER. The OWNER will not be responsible for any portion of the removal of the equipment from TOWN property.

PAYMENT

Payment shall be made by Cashier’s check or money order payable to the Town of Dartmouth within 15 business days of the awarded bid. Awarded bidders must remove the vehicle from Town property upon payment.
